Terms of Service

These Terms of Service are a legal agreement between you and Marketing Hog, the company that operates EngageCheck. EngageCheck is a product of Marketing Hog. They govern your access to and use of the EngageCheck website and tools. Please read them carefully.
1. Acceptance of these terms
By creating an account, running an audit, or otherwise using the Service, you agree to these Terms of Service (“Terms”) and to our Privacy Policy. If you do not agree, do not use the Service. If you use the Service on behalf of an organization, you represent that you are authorized to bind that organization to these Terms.
2. The Service
EngageCheck analyzes publicly available information about an Instagram account, including engagement, comments, and the accounts that engage, and produces an Audience Quality Score, signal grades, a plain-language verdict, and related insights such as engagement-pod detection, brand-safety flags, and account comparison. Scores and verdicts are probabilistic estimates derived from a sample of public data and automated analysis. They are not a definitive determination of fraud or authenticity.
3. Eligibility
You must be at least 18 years old and able to form a binding contract to use the Service. You agree to provide accurate account information and to keep it current.
4. Your account
You are responsible for safeguarding your login credentials and for all activity under your account. Notify us promptly through our contact form if you suspect unauthorized use. We are not liable for losses caused by unauthorized use of your account.
5. Credits, payments, and refunds
- Audits are powered by credits, which you purchase in advance. Pricing is shown on the site and may change for future purchases.
- One credit is consumed only when an audit completes successfully. A check that fails because an account is private, cannot be found, or has no public posts to analyze does not consume a credit.
- Card payments are processed by Stripe on behalf of Marketing Hog, the operator of EngageCheck. You authorize the applicable charge when you purchase credits. Your card statement may show MARKETING HOG* ENGAGECHECK or MARKETING HOG.
- Except where required by law, purchases and credits are non-refundable and credits have no cash value. We may, at our discretion, credit your account if a clear billing error occurs.
- You are responsible for any taxes associated with your purchase.
6. Acceptable use
You agree not to, and not to help others to:
- Use the Service for any unlawful, harassing, defamatory, discriminatory, or deceptive purpose, or to stalk, dox, or harm any person;
- Use reports to make decisions in violation of anti-discrimination, consumer-protection, employment, or other applicable laws;
- Scrape, resell, sublicense, or systematically extract the Service or its outputs, or build a competing product from them, except as expressly permitted by a written agreement (such as an API plan);
- Circumvent rate limits, credit requirements, authentication, or security measures, or access the Service through automated means except via an authorized API;
- Reverse engineer, interfere with, or disrupt the Service or its infrastructure, or introduce malicious code;
- Misrepresent a report as a guaranteed or official determination, or imply endorsement by EngageCheck, Instagram, or Meta.
7. Public data and Instagram
The Service reads only publicly available information and does not require Instagram credentials. You are responsible for ensuring your use of the Service and of any report complies with applicable laws and with the terms of any third-party platform. EngageCheck is an independent service and is not affiliated with, endorsed by, or sponsored by Instagram or Meta Platforms, Inc. All trademarks are the property of their respective owners.
8. No professional advice; accuracy
EngageCheck provides information to support your own judgment. It is not legal, financial, investment, or professional advice, and it is not a background check or consumer report under the Fair Credit Reporting Act or similar laws. Public data can be incomplete, sampled, or change over time, and automated analysis can be wrong. You are solely responsible for any decision you make based on a report.
9. Intellectual property
The Service, including its software, design, text, and the EngageCheck name and logo, is owned by Marketing Hog and protected by intellectual-property laws. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable license to use the Service and to use the reports you generate for your own internal business or personal purposes. You may not remove proprietary notices or use our branding without permission.
10. Third-party services
The Service relies on third parties for scraping, AI analysis, payments, and hosting. We are not responsible for third-party services, and your use of them may be subject to their own terms.
11. Disclaimers
The Service is provided “as is” and “as available” without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that any score, verdict, or insight is accurate, complete, or reliable.
12. Limitation of liability
To the maximum extent permitted by law, Marketing Hog and its owners, employees, and providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any lost profits, revenue, data, or goodwill, arising out of or relating to your use of the Service. To the maximum extent permitted by law, our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the three months before the event giving rise to the claim, or fifty US dollars (USD 50).
13. Indemnification
You agree to indemnify and hold harmless Marketing Hog and its owners, employees, and providers from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your use of the Service, your reports, or your violation of these Terms or of any law or third-party right.
14. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms, if required by law, or to protect the Service or other users. Sections that by their nature should survive termination will survive, including ownership, disclaimers, limitation of liability, and indemnification.
15. Changes to the Service and these Terms
We may change, suspend, or discontinue any part of the Service at any time. We may also update these Terms; when we do, we will revise the “Last updated” date and, for material changes, provide additional notice. Your continued use of the Service after an update means you accept the revised Terms.
16. Governing law and disputes
These Terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict-of-law rules. You agree to first try to resolve any dispute with us informally through ourcontact form. Any dispute that cannot be resolved informally will be subject to the exclusive jurisdiction of the state and federal courts located in Wyoming, and you consent to personal jurisdiction there, except where applicable law gives you the right to bring proceedings in your place of residence.
17. Miscellaneous
These Terms and the Privacy Policy are the entire agreement between you and EngageCheck regarding the Service. If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
